Acree was wheeled into the courtroom in a wheelchair while a Jackson County Sheriff carried an oxygen tank that he had been using. Acree also appeared with a cast on one of his arms.

When asked if he wanted a public defender, Acree told Judge Bellamy that he needed a chance to talk to a lawyer he knows about possible representation. His bond was set at $2 million.
