Court records reveal that custody dispute led up to fatal Lee’s Summit shooting
Second individual may have been involved
LEE’S SUMMIT, Mo. (KCTV) - Court documents have revealed that a second individual may have been involved in a fatal Lee’s Summit shooting believed to be the result of a custody dispute.
A probable cause statement filed by the Lee’s Summit Police Department on Saturday, Nov. 23, indicates that Keith J. Marshall, 31, who has been charged with murder in connection to a deadly shooting, indicates that around 8 a.m. on Friday, a disturbance was reported at the home of Marshall’s ex-girlfriend.
Investigators said they were called to an address found to be the home of Marshall’s ex-girlfriend, their two children and her new fiancé, Craig Scott, 51. The caller, Marshall’s ex-girlfriend, reported a private number she believed to belong to him had called three times earlier that morning, however, she did not answer.
Law enforcement officials reported that when Marshall’s vehicle was seen in front of the pair’s home, Scott went outside to talk with him. However, witnesses said Marshall and an unknown man “bum-rushed” Scott and began to attack him.
Witnesses told investigators that Scott attempted to escape inside, however, the two other men forced their way into the home before a gunshot rang out. Scott was found deceased in his home by his fiancé and a roommate.
Police indicated that Marshall’s vehicle was seen on multiple security cameras headed in the same direction as Scott’s home at the time of the shooting. A search warrant was conducted at Marshall’s home - which was found to be shared with his parents - and his vehicle. Multiple items, including brass knuckles and a holster, were seized.
Investigators revealed that in the weeks leading up to the shooting, Marshall and his ex-girlfriend had been involved in multiple disputes over the custody of their shared children. In fact, she had gone to his house the day before the shooting to retrieve one of their children whom he refused to return.
Lee’s Summit Police said Marshall’s parents also confirmed this to investigators. They said he returned home the morning of the shooting before they had a conversation which led to a call with their attorney and Marshall turning himself in.
The Jackson County, Missouri, Prosecutor’s Office has charged Marshall with murder in the second degree, burglary in the first degree, unlawful use of a weapon and two counts of armed criminal action.
In regard to the second individual seen by witnesses during the disturbance, the Lee’s Summit Police Department has told KCTV5 that the investigation remains ongoing. No further information about this investigation has been released.
As of Wednesday, Nov. 27, Marshall remains behind Jackson County bars on a $250,000 bond. An initial court appearance was held on Monday with a bond review hearing expected to be held at 1 p.m. on Wednesday, Dec. 4, and a preliminary hearing at 10:30 a.m. on Dec. 23.
